Terms of Service
These Terms govern your use of the Silicraft Industrial website and any quotation, sample, tooling, or production engagement you enter into with us.
1. Acceptance
By accessing silicraft.lumorb.com or sending any inquiry to [email protected], you agree to these Terms. If you do not agree, do not use the website or engage our engineering team.
2. Scope of service
Silicraft Industrial is an OEM / ODM manufacturer of liquid silicone rubber (LSR), high-consistency rubber (HCR), and over-molded assemblies across five grades: food, medical, electronic, infant & mother care, and industrial. We accept inquiries, quotes, tooling, sampling, validation, mass production, and outbound logistics only under a signed quotation or master supply agreement.
3. No quotation without a signed offer
Information on the website — including grades, tolerances, certifications, capacities, lead times, and indicative pricing — is for general communication only. It does not constitute an offer. A binding quotation requires (a) receipt of a written request for quotation, (b) review by our application engineering team, and (c) our countersigned quotation sheet.
4. Engineering samples
T1 samples are produced for fit, finish, and regulatory testing. They are not certified for end-use unless an explicit PPAP / FAI report is issued. Samples remain our property until paid for in full.
5. Tooling ownership
Unless an executed tooling transfer agreement states otherwise, all tooling, fixtures, gauges, and moulds remain our property. Tooling amortisation is calculated against agreed volume and recovered over the unit price until fully paid; upon full amortisation, ownership transfers to the buyer without further action.
6. Regulatory and certification
We hold ISO 13485, ISO 9001, FDA 21 CFR Part 820, LFGB, EU 1935/2004, RoHS / REACH, CE, IATF 16949, and operate a Class 8 cleanroom. Certificates are released to a counterparty only after execution of a non-disclosure agreement.
7. Confidentiality
All drawings, mould-flow simulations, recipes, process parameters, and quotations shared between us are confidential. The recipient may not disclose them to any third party without prior written consent, except where disclosure is required by law.
8. Limitation of liability
To the maximum extent permitted by applicable law, our aggregate liability under any engagement is capped at the fees actually paid by you to us for the affected lot. We are not liable for indirect, incidental, consequential, or punitive damages.
9. Force majeure
Neither party is liable for delay or failure caused by events beyond reasonable control, including but not limited to natural disasters, government action, war, pandemic, embargo, labour disputes, power or supply-chain interruption.
10. Intellectual property
We retain all intellectual property in our tooling designs, mould-flow analyses, recipes, and process know-how. You retain all intellectual property in your product design, brand, and trademarks. Each party grants the other a limited, non-exclusive licence to use the shared materials solely to perform the engagement.
11. Governing law and venue
These Terms are governed by the laws of Hong Kong SAR. Any dispute is subject to the exclusive jurisdiction of the courts of Hong Kong, without prejudice to either party's right to seek interim injunctive relief in any competent jurisdiction.
